Terms of Service

1. Acceptance

By creating an account or using the My Duka platform, you agree to these Terms of Service. If you do not agree, do not use the service.

2. The service

My Duka provides an AI-powered WhatsApp sales assistant for businesses. We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

3. Accounts

• You must provide accurate information when creating your account
• You are responsible for all activity that occurs under your account
• You must be at least 18 years old to use the service
• One person or legal entity may not maintain more than one free account

4. Payment and billing

• Paid plans are billed monthly via M-Pesa
• All prices are in Kenyan Shillings (KES) and inclusive of applicable taxes
• Subscriptions auto-renew each month unless cancelled
• Refunds are not provided for partial months
• We reserve the right to change pricing with 30 days notice

5. Acceptable use

You may not use My Duka to:

• Send spam or unsolicited messages
• Sell illegal products or services
• Impersonate another person or entity
• Violate WhatsApp Business Policy
• Engage in any activity that violates Kenyan law

6. Intellectual property

The My Duka platform, including its design, software, and content, is owned by us and protected by applicable intellectual property laws. Your content (products, messages) remains yours.

7. Limitation of liability

My Duka is provided "as is". We are not liable for any indirect, incidental, or consequential damages arising from your use of the service, including lost sales or business interruption.

8. Termination

You may cancel your account at any time from the dashboard. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted within 30 days.

9. Governing law

These terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.
